data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>No contexto das VII Jornadas da Sociedade Pedi\u00e1trica da Qualidade e Seguran\u00e7a do Doente, no dia 12<sup>th<\/sup> de Dezembro de 2025, fui desafiada a refletir sobre a seguinte quest\u00e3o: H\u00e1 qualidade nos cuidados de sa\u00fade, sem cumprir os direitos das crian\u00e7as?<\/p><p>Quando falamos de qualidade de cuidados de sa\u00fade \u00e9 imperativo falarmos do direito da crian\u00e7a a gozar do melhor estado de sa\u00fade poss\u00edvel e a beneficiar de servi\u00e7os m\u00e9dicos e de reeduca\u00e7\u00e3o, Artigo 24 da Conven\u00e7\u00e3o das Na\u00e7\u00f5es Unidas sobre os Direitos da Crian\u00e7a, tamb\u00e9m conhecido como o direito \u00e0 sa\u00fade. E, conforme os princ\u00edpios de direitos humanos, o Artigo 24 dever\u00e1 ser compreendido e aplicado em rela\u00e7\u00e3o aos restantes direitos da Conven\u00e7\u00e3o. Ou seja, n\u00e3o \u00e9 poss\u00edvel aplicar o direito \u00e0 sa\u00fade, sem aplicar o direito da crian\u00e7a \u00e0 n\u00e3o-discrimina\u00e7\u00e3o, o princ\u00edpio do superior interesse da crian\u00e7a, ou das capacidades em desenvolvimento e por a\u00ed fora. Al\u00e9m disso, o Comit\u00e9 para os Direitos da Crian\u00e7a, a entidade que monitoriza a aplica\u00e7\u00e3o da Conven\u00e7\u00e3o, tem vindo a interpretar os artigos, dando orienta\u00e7\u00f5es sobre como aplicar os mesmos nos v\u00e1rios contextos de sa\u00fade da crian\u00e7a, incluindo o sistema de sa\u00fade. Por exemplo em rela\u00e7\u00e3o ao Artigo 12, hoje conhecido como o direito \u00e0 participa\u00e7\u00e3o, o Comit\u00e9 reconhece o direito da crian\u00e7a a ser informada sobre a sua situa\u00e7\u00e3o de sa\u00fade, a participar nas tomadas de decis\u00e3o, incluindo o direito ao consentimento informado, bem como a participar na avalia\u00e7\u00e3o e melhoria dos servi\u00e7os de sa\u00fade (1). Os direitos t\u00eam, portanto, uma aplica\u00e7\u00e3o pr\u00e1tica ao n\u00edvel dos servi\u00e7os de sa\u00fade.<\/p><p>Voltando \u00e0 quest\u00e3o colocada a esta mesa redonda \u2013 poder\u00e1 realmente existir Qualidade Nos Cuidados De Sa\u00fade, Sem Cumprir Os Direitos Das Crian\u00e7as? \u2013 a partir dos anos 80, na Europa, percebeu-se que, apesar do progresso da medicina e dos melhores resultados em sa\u00fade infantil, a qualidade e a experi\u00eancia de cuidados de sa\u00fade variava de crian\u00e7a para crian\u00e7a, mas n\u00e3o s\u00f3. Com a ado\u00e7\u00e3o da Conven\u00e7\u00e3o, a evidencia ao n\u00edvel dos determinantes sociais da sa\u00fade, entre outras quest\u00f5es, percebeu-se que a qualidade de cuidados n\u00e3o est\u00e1 apenas relacionada com a aplica\u00e7\u00e3o de protocolos m\u00e9dicos ou a efic\u00e1cia dos tratamentos. Todas as iniciativas que foram criadas a partir de final dos anos 80 t\u00eam como base este pressuposto. Alguns dos primeiros exemplos s\u00e3o a ado\u00e7\u00e3o da Carta Europeia da Crian\u00e7a Hospitalizada (2) e o programa Child-Friendly Healthcare Initiative (3). Num dos primeiros artigos cient\u00edficos publicados sobre esta abordagem em 2000, Southall e outros argumentavam que at\u00e9 nos pa\u00edses ricos, onde existiam bons recursos, \u201cos avan\u00e7os na \u00e1rea da sa\u00fade nem sempre foram acompanhados por uma aten\u00e7\u00e3o proporcional ao bem-estar geral da crian\u00e7a e por uma preocupa\u00e7\u00e3o suficiente com as suas ansiedades, medos e sofrimento.\u201d A iniciativa propunha, \u201cde acordo com a Conven\u00e7\u00e3o, desenvolver um sistema de cuidados que se concentre no bem-estar f\u00edsico, psicol\u00f3gico e emocional das crian\u00e7as que s\u00e3o vistas nas unidades de sa\u00fade, especialmente em internamento (4).\u201d<\/p><p>Este programa foi um verdadeiro pilar para as iniciativas que se seguiram e a funda\u00e7\u00e3o para as organiza\u00e7\u00f5es europeias e internacionais come\u00e7arem a falar de uma abordagem centrada nos direitos humanos, aplicada \u00e0 sa\u00fade e os direitos da crian\u00e7a. Por exemplo, o Conselho da Europa adota em 2011 as Orienta\u00e7\u00f5es sobre os Cuidados de Sa\u00fade adaptados \u00e0s Crian\u00e7as e uma Declara\u00e7\u00e3o de Ministros sobre o mesmo tema (5); e o Comit\u00e9 Europeu da Organiza\u00e7\u00e3o Mundial da Sa\u00fade adota uma s\u00e9rie de ferramentas e processos de avalia\u00e7\u00e3o da qualidade dos cuidados de sa\u00fade, com base nos direitos da crian\u00e7a, a partir da mesma altura (6).<\/p><p>Com esta abordagem, a legisla\u00e7\u00e3o internacional e nacional passa a ter uma aplica\u00e7\u00e3o muito concreta ao n\u00edvel dos servi\u00e7os de sa\u00fade. A Conven\u00e7\u00e3o sobre os Direitos da Crian\u00e7a deve ser transposta para a legisla\u00e7\u00e3o nacional, as pol\u00edticas p\u00fablicas, a forma\u00e7\u00e3o de profissionais e organiza\u00e7\u00e3o dos servi\u00e7os, numa l\u00f3gica de melhoria cont\u00ednua, de acordo com a situa\u00e7\u00e3o da inf\u00e2ncia. E, ao n\u00edvel dos servi\u00e7os, esta abordagem assenta em sete princ\u00edpios, nomeadamente:<\/p><ol><li><strong>Disponibilidade de servi\u00e7os de sa\u00fade<\/strong>incluindo a organiza\u00e7\u00e3o, exist\u00eancia de v\u00e1rias tipologias de servi\u00e7os necess\u00e1rios e distribui\u00e7\u00e3o geogr\u00e1fica dos mesmos;<\/li><li><strong>Acesso aos cuidados de sa\u00fade<\/strong>ou seja, acesso f\u00edsico e econ\u00f3mico aos mesmos, sem constrangimentos, bem como acesso \u00e0 informa\u00e7\u00e3o;<\/li><li><strong>Aceita\u00e7\u00e3o dos cuidados de sa\u00fade<\/strong>ou seja, os servi\u00e7os de cuidados de sa\u00fade dispon\u00edveis devem ser aceites por todos os grupos populacionais, independentemente das suas caracter\u00edsticas e no respeito pelas suas necessidades pr\u00f3prias;<\/li><li><strong>Qualidade dos servi\u00e7os<\/strong> ao n\u00edvel da sua efic\u00e1cia, tendo em conta as necessidades da popula\u00e7\u00e3o e assentes em protocolos cl\u00ednicos e evid\u00eancia cient\u00edfica;<\/li><li><strong>Participa\u00e7\u00e3o<\/strong>ou seja, \u00e9 um direito das crian\u00e7as participar nos cuidados de sa\u00fade a n\u00edvel individual, por exemplo nas decis\u00f5es sobre os seus cuidados (assentimento e consentimento informado), e a n\u00edvel de grupo, ou seja, no desenho, planeamento e avalia\u00e7\u00e3o dos servi\u00e7os existentes;<\/li><li><strong>Igualdade e n\u00e3o-discrimina\u00e7\u00e3o<\/strong>ou seja, todas as pessoas t\u00eam o direito a usufruir dos cuidados sem discrimina\u00e7\u00e3o de qualquer tipo, conforme os princ\u00edpios anteriores;<\/li><li><strong>Responsabilidade<\/strong> ao n\u00edvel do sistema de sa\u00fade, sob a forma de sistemas de acredita\u00e7\u00e3o, monitoriza\u00e7\u00e3o e avalia\u00e7\u00e3o, mas tamb\u00e9m ao n\u00edvel da compensa\u00e7\u00e3o (7).<\/li><\/ol><p>Como dito anteriormente, a partir de finais dos anos 80, com uma acelera\u00e7\u00e3o nos anos 2000, foram promovidas v\u00e1rias iniciativas que visavam melhorar a qualidade nos cuidados de sa\u00fade, com base nos direitos da crian\u00e7a, mas faltava adotar padr\u00f5es globais. Em 2018, e com base nas experi\u00eancias realizadas at\u00e9 ent\u00e3o, nomeadamente ao n\u00edvel da avalia\u00e7\u00e3o da qualidade de cuidados de sa\u00fade pedi\u00e1tricos, a Organiza\u00e7\u00e3o Mundial de Sa\u00fade adotou padr\u00f5es para a qualidade de cuidados em sa\u00fade infantil, que incluem a qualidade na perspetiva da efic\u00e1cia cl\u00ednica e do respeito, a prote\u00e7\u00e3o e a realiza\u00e7\u00e3o dos direitos da crian\u00e7a (8). De acordo com o documento, para se assegurar a qualidade de cuidados de sa\u00fade, \u00e9 preciso garantir, entre outros, os seguintes direitos:<\/p><ol><li>Uma comunica\u00e7\u00e3o efetiva com as crian\u00e7as e fam\u00edlias, incluindo a participa\u00e7\u00e3o dos processos de tomada de decis\u00e3o, o que pressup\u00f5e a disponibiliza\u00e7\u00e3o de informa\u00e7\u00e3o em diferentes formatos, a ado\u00e7\u00e3o e divulga\u00e7\u00e3o de uma carta de direitos e pol\u00edticas internas sobre assentimento e consentimento informado;<\/li><li>O acesso aos servi\u00e7os, sem discrimina\u00e7\u00e3o;<\/li><li>A prote\u00e7\u00e3o contra todas as formas de viol\u00eancia;<\/li><li>Reconhecimento do papel e exerc\u00edcio dos direitos dos pais;<\/li><li>O direito \u00e0 educa\u00e7\u00e3o e ao brincar.<\/li><\/ol><p>A quest\u00e3o se poder\u00e1 haver qualidade nos cuidados de sa\u00fade sem cumprir os direitos da crian\u00e7a, \u00e9 simples. A experi\u00eancia mostra-nos que os direitos da crian\u00e7a s\u00e3o uma componente integrante da qualidade. Algumas das quest\u00f5es que se colocam hoje s\u00e3o, por um lado, ainda termos que justificar e lutar para que o cumprimento dos direitos da crian\u00e7a receba a devida aten\u00e7\u00e3o e m\u00e9rito, por exemplo, ao n\u00edvel dos sistemas de acredita\u00e7\u00e3o; e, por outro lado, com a falta de investimento nesta \u00e1rea e os desafios novos que desde sempre acompanharam a pediatria, como \u00e9 que ser\u00e1 poss\u00edvel dar continuidade aos avan\u00e7os ao n\u00edvel da humaniza\u00e7\u00e3o de cuidados e do cumprimento dos direitos da crian\u00e7a que se alcan\u00e7aram at\u00e9 aqui.<\/p><p>(1) United Nations Committee on the Rights of the Child.
