data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Dans le cadre des VIIe Journ\u00e9es de la Soci\u00e9t\u00e9 p\u00e9diatrique pour la qualit\u00e9 et la s\u00e9curit\u00e9 des patients, le 12<sup>th<\/sup> d\u00e9cembre 2025, j'ai \u00e9t\u00e9 invit\u00e9e \u00e0 r\u00e9fl\u00e9chir \u00e0 la question suivante : peut-on garantir la qualit\u00e9 des soins de sant\u00e9 sans respecter les droits des enfants ?<\/p><p>Lorsque nous parlons de qualit\u00e9 des soins de sant\u00e9, il est imp\u00e9ratif de mentionner le droit de l'enfant \u00e0 jouir du meilleur \u00e9tat de sant\u00e9 possible et \u00e0 b\u00e9n\u00e9ficier de services m\u00e9dicaux et de r\u00e9\u00e9ducation, article 24 de la Convention des Nations Unies relative aux droits de l'enfant, \u00e9galement connu sous le nom de droit \u00e0 la sant\u00e9. Et, conform\u00e9ment aux principes des droits de l'homme, l'article 24 doit \u00eatre compris et appliqu\u00e9 en relation avec les autres droits de la Convention. En d'autres termes, il n'est pas possible d'appliquer le droit \u00e0 la sant\u00e9 sans appliquer le droit de l'enfant \u00e0 la non-discrimination, le principe de l'int\u00e9r\u00eat sup\u00e9rieur de l'enfant, ou celui des capacit\u00e9s en d\u00e9veloppement, etc. En outre, le Comit\u00e9 des droits de l'enfant, l'organisme qui surveille l'application de la Convention, a interpr\u00e9t\u00e9 les articles et donn\u00e9 des orientations sur la mani\u00e8re de les appliquer dans les diff\u00e9rents contextes li\u00e9s \u00e0 la sant\u00e9 de l'enfant, y compris le syst\u00e8me de sant\u00e9. Par exemple, en ce qui concerne l'article 12, aujourd'hui connu sous le nom de droit \u00e0 la participation, le Comit\u00e9 reconna\u00eet le droit de l'enfant \u00e0 \u00eatre inform\u00e9 de son \u00e9tat de sant\u00e9, \u00e0 participer \u00e0 la prise de d\u00e9cision, y compris le droit au consentement \u00e9clair\u00e9, ainsi qu'\u00e0 participer \u00e0 l'\u00e9valuation et \u00e0 l'am\u00e9lioration des services de sant\u00e9 (1). Les droits ont donc une application pratique au niveau des services de sant\u00e9.<\/p><p>Pour revenir \u00e0 la question pos\u00e9e lors de cette table ronde \u2013 peut-il vraiment y avoir une qualit\u00e9 des soins de sant\u00e9 sans respecter les droits des enfants ? \u2013 \u00e0 partir des ann\u00e9es 80, en Europe, on s'est rendu compte que, malgr\u00e9 les progr\u00e8s de la m\u00e9decine et l'am\u00e9lioration des r\u00e9sultats en mati\u00e8re de sant\u00e9 infantile, la qualit\u00e9 et l'exp\u00e9rience des soins de sant\u00e9 variaient d'un enfant \u00e0 l'autre, mais pas seulement. Avec l'adoption de la Convention, les preuves au niveau des d\u00e9terminants sociaux de la sant\u00e9, entre autres questions, ont montr\u00e9 que la qualit\u00e9 des soins n'est pas seulement li\u00e9e \u00e0 l'application de protocoles m\u00e9dicaux ou \u00e0 l'efficacit\u00e9 des traitements. Toutes les initiatives qui ont vu le jour \u00e0 partir de la fin des ann\u00e9es 80 reposent sur ce principe. Parmi les premiers exemples, on peut citer l'adoption de la Charte europ\u00e9enne de l'enfant hospitalis\u00e9 (2) et le programme Child-Friendly Healthcare Initiative (3). Dans l'un des premiers articles scientifiques publi\u00e9s sur cette approche en 2000, Southall et al. affirmaient que m\u00eame dans les pays riches, o\u00f9 les ressources \u00e9taient importantes, \u00ab les progr\u00e8s dans le domaine de la sant\u00e9 n'ont pas toujours \u00e9t\u00e9 accompagn\u00e9s d'une attention proportionnelle au bien-\u00eatre g\u00e9n\u00e9ral de l'enfant et d'une pr\u00e9occupation suffisante pour ses angoisses, ses peurs et sa souffrance \u00bb. L'initiative proposait, \u00ab conform\u00e9ment \u00e0 la Convention, de d\u00e9velopper un syst\u00e8me de soins ax\u00e9 sur le bien-\u00eatre physique, psychologique et \u00e9motionnel des enfants pris en charge dans les \u00e9tablissements de sant\u00e9, en particulier ceux hospitalis\u00e9s (4) \u00bb.<\/p><p>Ce programme a \u00e9t\u00e9 un v\u00e9ritable pilier pour les initiatives qui ont suivi et a permis aux organisations europ\u00e9ennes et internationales de commencer \u00e0 parler d'une approche centr\u00e9e sur les droits humains, appliqu\u00e9e \u00e0 la sant\u00e9 et aux droits de l'enfant. Par exemple, le Conseil de l'Europe a adopt\u00e9 en 2011 les Lignes directrices sur les soins de sant\u00e9 adapt\u00e9s aux enfants et une D\u00e9claration des ministres sur le m\u00eame th\u00e8me (5) ; et le Comit\u00e9 europ\u00e9en de l'Organisation mondiale de la sant\u00e9 a adopt\u00e9 \u00e0 la m\u00eame \u00e9poque une s\u00e9rie d'outils et de processus d'\u00e9valuation de la qualit\u00e9 des soins de sant\u00e9, fond\u00e9s sur les droits de l'enfant (6).<\/p><p>Avec cette approche, la l\u00e9gislation internationale et nationale trouve une application tr\u00e8s concr\u00e8te au niveau des services de sant\u00e9. La Convention relative aux droits de l'enfant doit \u00eatre transpos\u00e9e dans la l\u00e9gislation nationale, les politiques publiques, la formation des professionnels et l'organisation des services, dans une logique d'am\u00e9lioration continue, en fonction de la situation de l'enfance. Au niveau des services, cette approche repose sur sept principes, \u00e0 savoir :<\/p><ol><li><strong>Disponibilit\u00e9 des services de sant\u00e9<\/strong>y compris l'organisation, l'existence de diff\u00e9rents types de services n\u00e9cessaires et leur r\u00e9partition g\u00e9ographique ;<\/li><li><strong>Acc\u00e8s aux soins de sant\u00e9<\/strong>c'est-\u00e0-dire un acc\u00e8s physique et \u00e9conomique sans contrainte, ainsi qu'un acc\u00e8s \u00e0 l'information ;<\/li><li><strong>Acceptation des soins de sant\u00e9<\/strong>c'est-\u00e0-dire que les services de sant\u00e9 disponibles doivent \u00eatre accept\u00e9s par tous les groupes de population, quelles que soient leurs caract\u00e9ristiques et dans le respect de leurs besoins sp\u00e9cifiques ;<\/li><li><strong>Qualit\u00e9 des services<\/strong> en termes d'efficacit\u00e9, en tenant compte des besoins de la population et en se basant sur des protocoles cliniques et des preuves scientifiques ;<\/li><li><strong>Participation<\/strong>en d'autres termes, les enfants ont le droit de participer aux soins de sant\u00e9 \u00e0 titre individuel, par exemple dans les d\u00e9cisions concernant leurs soins (accord et consentement \u00e9clair\u00e9), et \u00e0 titre collectif, c'est-\u00e0-dire dans la conception, la planification et l'\u00e9valuation des services existants.<\/li><li><strong>\u00c9galit\u00e9 et non-discrimination<\/strong>c'est-\u00e0-dire que tout le monde a le droit de b\u00e9n\u00e9ficier de soins sans discrimination d'aucune sorte, conform\u00e9ment aux principes pr\u00e9c\u00e9dents ;<\/li><li><strong>Responsabilit\u00e9<\/strong> au niveau du syst\u00e8me de sant\u00e9, sous la forme de syst\u00e8mes d'accr\u00e9ditation, de suivi et d'\u00e9valuation, mais aussi au niveau de la compensation (7).<\/li><\/ol><p>Comme indiqu\u00e9 pr\u00e9c\u00e9demment, \u00e0 partir de la fin des ann\u00e9es 80, avec une acc\u00e9l\u00e9ration dans les ann\u00e9es 2000, plusieurs initiatives visant \u00e0 am\u00e9liorer la qualit\u00e9 des soins de sant\u00e9, fond\u00e9es sur les droits de l'enfant, ont \u00e9t\u00e9 promues, mais il restait \u00e0 adopter des normes mondiales. En 2018, sur la base des exp\u00e9riences men\u00e9es jusqu'alors, notamment en mati\u00e8re d'\u00e9valuation de la qualit\u00e9 des soins de sant\u00e9 p\u00e9diatriques, l'Organisation mondiale de la sant\u00e9 a adopt\u00e9 des normes pour la qualit\u00e9 des soins de sant\u00e9 infantile, qui incluent la qualit\u00e9 du point de vue de l'efficacit\u00e9 clinique et du respect, de la protection et de la r\u00e9alisation des droits de l'enfant (8). Selon ce document, pour garantir la qualit\u00e9 des soins de sant\u00e9, il faut notamment garantir les droits suivants :<\/p><ol><li>Une communication efficace avec les enfants et les familles, y compris leur participation aux processus d\u00e9cisionnels, ce qui suppose la mise \u00e0 disposition d'informations sous diff\u00e9rents formats, l'adoption et la diffusion d'une charte des droits et de politiques internes sur le consentement \u00e9clair\u00e9 ;<\/li><li>Acc\u00e8s aux services, sans discrimination ;<\/li><li>La protection contre toutes les formes de violence ;<\/li><li>Reconnaissance du r\u00f4le et exercice des droits des parents ;<\/li><li>Le droit \u00e0 l'\u00e9ducation et au jeu<\/li><\/ol><p>La question de savoir s'il peut y avoir qualit\u00e9 dans les soins de sant\u00e9 sans respecter les droits de l'enfant est simple. L'exp\u00e9rience nous montre que les droits de l'enfant font partie int\u00e9grante de la qualit\u00e9. Certaines des questions qui se posent aujourd'hui sont, d'une part, que nous devons encore justifier et lutter pour que le respect des droits de l'enfant re\u00e7oive l'attention et le m\u00e9rite qu'il m\u00e9rite, par exemple au niveau des syst\u00e8mes d'accr\u00e9ditation ; et, d'autre part, avec le manque d'investissement dans ce domaine et les nouveaux d\u00e9fis qui ont toujours accompagn\u00e9 la p\u00e9diatrie, comment il sera possible de poursuivre les progr\u00e8s r\u00e9alis\u00e9s jusqu'\u00e0 pr\u00e9sent en mati\u00e8re d'humanisation des soins et de respect des droits de l'enfant.<\/p><p>(1) United Nations Committee on the Rights of the Child.
